China Certification of Weapons and Equipment Research and Production License

 The Weapons and Equipment Research and Production License refers to the administrative act by which the national defense technology industry administrative authority grants qualifications to enterprises and institutions to engage in weapons and equipment research and production activities based on their applications. It is a fundamental system in the management of military research and production, essential for implementing military procurement and ensuring legal and orderly conduct in military research and production.

1. Certification Authorities:

   The Equipment Development Department of the Central Military Commission is responsible for handling the acceptance of first-category licenses (including simultaneous applications for first and second-category licenses). Provincial, autonomous region, and municipality-level defense technology industry management departments handle the acceptance of second-category licenses.

2. Application Conditions:

   1). Enterprises registered and domiciled within the People's Republic of China as legal entities or public institutions.

   2). Projects or products involved in weapons and equipment research and production that deal with state secrets.

   3). No overseas (including Hong Kong, Macao, Taiwan) majority ownership or direct investment; indirect foreign investments and their ultimate controllers' contributions should not exceed 20%.

   4). Legal representatives, key executives, actual controllers, board members, senior management personnel, and personnel involved in or intended for confidential weapons and equipment research and production tasks must be Chinese nationals without overseas permanent residency or long-term residency permits, and must not have marital relationships with foreign nationals (including those from Hong Kong, Macao, Taiwan).

   5). Must have fixed research and production facilities and capabilities to undertake confidential weapons and equipment research and production tasks.

   6). Must have a sound secrecy system with dedicated personnel or institutions responsible for secrecy work, and facilities, equipment, and premises that meet national secrecy regulations and standards.

   7). The enterprise must have been registered for at least 3 years and have no incidents of leakage of secrets within the past year.

   8). No records of illegally acquiring or holding state secrets or other serious illegal activities.

3. Application Process: Certification of Weapons and Equipment Research and Production License (see Figure 1).

4. Application Materials:

   1). Application for Secrecy Qualification of Weapons and Equipment Research and Production Units.

   2). Secrecy Level Recommendation Form (application units may choose to issue at military group companies, project general contracting units, or equipment manufacturing qualification acceptance points).

   3). Business license or registration certificate for public institutions, organization code certificate (copy, now unified into one document).

   4). Articles of association.

   5). Financial audit report for the previous year.

   6). Property ownership certificate or lease contract for research and production premises (copy).

   7). Other materials as required by the National Military Secrecy Certification Committee.

Through licensing and record management, it ensures effective monitoring of the research and production capabilities of enterprises and institutions engaged in weapons and equipment research and production activities, thereby safeguarding the integrity, advancement, and security of China's weapons and equipment research and production system. The implementation of record management for weapons and equipment research and production is an important measure for the State Administration of Science, Technology and Industry for National Defense to implement the strategy of integrating military and civilian development and the reform requirements of the State Council's "streamlining administration, delegating power, and improving regulation and services".
